Aaaah! What’s The Big Fuss Over Team Archie’s Promo Video?

As everyone would have known by now, the Team Archie Gifting Campaign Promo video created by Jacobo Leon and posted in YouTube has been pulled out, apparently due to a copyright claim by Sony/BMG. We would like to let everyone know that there was no infringement intended on creating that video (as seen in our disclaimer attached in the “more info” area). Our team is currently in contact with Sony/BMG in the hope of settling this misunderstanding. So far, we have found out that Sony/BMG did not directly request the pull-out of the video but only forwarded a complaint that they have received which is just a normal protocol in situations such as this. We do appreciate their patience and guidance in directing us to the proper channels to ensure that no such situation will be encountered in the future. We are also currently contacting different agencies who we think would be able to enlighten us on certain aspects of the situation. We are trying our best to solve this problem legally and reasonably and to come out with more understanding regarding copyright laws and such. We apologize for any inconvenience that this may have caused anyone. We would just like to extend our gratitude to Jacobo and Oystar for all the hard work they have put into that video and we certainly don’t undermine the effort and time that they have spent in making the video a big success even for just a short period of time.

Editor’s note: From what Fan Scene was able to gather through sources at Sony, apparently someone saw the promo video on YouTube and reported it as a possible copyright violation. YouTube, following protocol, notified Sony/BMG, at which time the Sony/BMG licensing department got involved and asked YouTube to take down the video. Jacobo who produced the video will probably receive a cease and desist letter (standard procedure) which simply means not to do it again, if Sony wants to be nice about it.

The issue with the video is 3 things:

The record labels are out to make money. The more money they make, the better off they are, and they see anyone else’s promotions or advertising as someone being ‘in their way.’ The 5 big record companies – of which Sony is one of the main components – don’t see the benefit of what Team Archie is doing. They view them as someone trying to advertise, using their product, for commercial gain.

Team Archie, clearly, is not.

Dare we say…

The copyright issue comes into play because of 3 things, as I tried to explain earlier;

1. The actual Crush song was used (copyrighted song)
2. Actual footage from Crush music video and AI was used (Copyrighted material)
The AI portion of it is copyright by American Idol and 19 Entertainment
3. Song used for advertising purposes

Whether it be for profit or non-profit they don’t care. They want money. That is what the whole thing is about. Michelle,  a moderator at Team Archie, contacted Sony’s licensing dept and they promised to send her all the info about the license or whatnot. Michelle said Sony was very nice to her and explained what may have lead to the problem, etc…

If there’s some new “promote David license” we should know about, I think Fan Scene should be grandfathered in.

    It’s hard to understand why “they” do what they do,
    I guess they have their reasons.

    We have our reasons for what we do as well.
    David’s fans are the best.

  4. We will continue to support David and his music no matter what. We “the fans” are what make the artist. Without “the fans” there is nothing. The “EXISTING FANS” is what drives new fans and new sales and therefore propel the artist forward by benefiting both the artist and the record label.
